Five years jail for testing new medicines on patients

A bill likely to be presented in the budget session of Parliament to amend the provisions of New Medicines and Cosmetics (Amendment) Bill 2015 making a provision for 5 years imprisonment if Doctors and Pharmaceutical Companies use new medicines for experimenting on the patients violating this law. If this bill is passed in the parliament, those who violate it will be punished. It is expected that this bill will be passed in the next session of the Parliament.

The report shows that if any new medicine is used on the patients on an experimental basis it will be treated as violation of Section 4A of this bill. In addition to giving punishment of 3-5 years imprisonment a fine up to Rs. 5 lakh could be imposed. If anyone violates this law for the second time, the duration of imprisonment will not be less than 3 years and fine would be at least Rs. 15 lakh. It may be noted that many patients in the villages of A.P. State died due to such experimentations of new medicines.
