Abu Dhabi, April 29: The Labour Court in Abu Dhabi has said that non-payment of the salary of workers on time is a sort of arbitrary termination of service which deserves financial compensation.
The compensation will be determined by the court if the value of the compensation exceeds the salary for three months based on the last basic salary in all circumstances, it said, as it ruled against a construction company in Abu Dhabi in a case filed by a driver, Adel Ismail, at the labour disputes section of the Ministry of Labour.
The driver demanded payment of the delayed salary for six months and a compensation for arbitrary sacking, after-service benefits and ticket fare for a flight to his country.
As the company representative refused to meet these demands, the ministry referred the case to the Labour Court which ordered the company owner to pay Dh20,500 to the driver in addition to the flight fare.
If the company owner refuses to comply with the court ruling, the competent authorities will send the worker to his home country at the expense of the employer and collect the compensation amount from the company under receivership under Article 131 of the labour law.
