Fair Trade Regulator Dismisses Complaint Against DLF Group Firms

New Delhi: The Competition Commission of India (CCI) has rejected allegations of anti-competitive business practices against two DLF Group firms.

Dismissing the complaint, fair trade regulator CCI said there is no “prima facie” case of violation of competition norms.

The complaint pertained to abuse of dominant position by DLF Qutab Enclave Complex Educational Charitable Trust and DLF Ltd for leasing plots for developing and running creches/play schools in residential areas.

The market watchdog has dismissed the allegations after finding that prima-facie there was no violation of competition norms since these firms are not in a dominant position in the relevant market.

“The potential developer of a creche/play school does not necessarily require to develop/run the same within the residential colony/complex only.”

“Therefore, considering that the relevant product market is not restricted to the plots earmarked for amenities in the residential colonies, the Commission does not find OP1/ DLF Group to be dominant,” CCI said in an order dated November 11.

Accordingly, CCI finds “no prima facie case of contravention of the provisions of section 4 of the Act by DLF Group”.

Section 4 pertains to abuse of dominant position.
