New Delhi, June 03: A Delhi court today dismissed a plea of Rahul Mahajan, son of slain BJP leader Pramod Mahajan, seeking return of his mobile phone, SIM card and other belongings seized by police following his alleged involvement in a drug abuse case in 2006.
“The alleged seized objects of the accused form part of the case properties and they cannot be released to him at this stage. Hence, the application is dismissed,” Additional Sessions Judge J P S Malik said.
Mahajan (35) who recently married model Dimpy Ganguly in a reality show, had filed an application for release of his belongings.
He is accused of consuming and distributing drugs at the official residence of his slain father on the night of June two, 2006.
Mahajan, along with his late father’s secretary Vivek Moitra, was admitted to Apollo Hospital here after allegedly consuming contraband drugs. Moitra later died in the hospital. Police had seized his belongings during the probe.
Meanwhile, the court today said coercive actions would be taken against Nigerian nationals, Abdul Latif Ashola alias Mohd Abdullah and Egbedokun James Taiwo, co-accused in the case, as they have stopped appearing before it after getting bail.
It ordered forfeiture of the bail bond of Taiwo, besides issuing non-bailable warrants against him.
The court also asked police to start the process of declaring Abdul Latif Ashola as proclaimed offender.
Mahajan, who was arrested on June 5, 2006, under the Narcotic Drugs and Psychotropic Substances Act, has been on bail since June 14 that year.
The trial in the drug abuse case against Mahajan and others is yet to start as the records are with the Delhi High court, which is hearing various revision petitions against framing of charges under the NDPS Act.
The High Court is hearing a bunch of petitions filed by Mahajan, one Sahil Zaroo, Harish Sharma, personal assistant of Pramod Mahajan, challenging the framing of charges against them.
