New Delhi: Noted legal expert Prof Tahir Mahmood termed the demand for scheduled caste reservation in minority institutions as unconstitutional. He said under the constitutional and judicial judgments reservation to scheduled castes is not compulsory.
Former Chairman National Minority Commission told UNI said that the judgments in which the Supreme Court in 1992 had told to reserve 50 pc seats for minority students in minority institutions, it had also told that the remaining seats must be filled purely on merit basis. There is no provision of reservation for scheduled castes in this court formula. He further clarified that in its later judgments Supreme Court made it clear that the 50 pc seats for minorities doesn’t fix a maximum limit but the number of reserved seats could be increased according to the minority population in any state.
