New Delhi, May 10: The Delhi High Court today granted A stay on a single judge”s order directing the Election Commission to hold fresh civic election in Vikas Puri municipal ward.
A division bench of Chief Justice Dipak Misra and Justice Sanjiv Khanna granted the stay till July 19 on an appeal filed by the councillor Balbir Tyagi, a BJP candidate, challenging the single judge”s order for fresh election.
On April 26, allowing a petition filed A Dhanwanti Chandela, a Jharkhand Mukti Morcha(JMM) candidate, the single judge had directed re-election of municipal ward no-116.
Chandela in his petition, had sought an order from the court to declare Tyagi”s election as null and void on the ground of alleged irregularities committed by him at the time of civic poll in 2007.
Chandela had also alleged Tyagi did not comply with the rules and the notification issued by the State Election Commission as regards maintenance of accounts and expenses.
It was alleged that Tyagi had spent huge amount towards advertisements in various newspapers and other media but showed on paper a small amount on the issue, which is violative of the election rules.
