New Delhi, July 08: A suspected Indian Mujahideen terrorist, allegedly involved in the September 13 Delhi serial blasts, on Wednesday approached the Delhi High Court seeking bail to appear in final semester exam of MBA.
Saquib Nisar, in custody since September 20, has approached the court stating that his examinations were scheduled to start on July 18.
The High Court had, earlier, refused to grant him interim bail when he was to appear in the fifth semester exam and had allowed him to write his paper from jail.
Saquib’s counsel today pleaded before the court that the gravity of the allegations cannot and should not bar the right of any accused to pursue studies.
Justice Geeta Mittal, after hearing the defence counsel’s plea, issued notice to city police and asked it to file a response by July 13, when his petition would be taken up for further hearing.
The police have already filed chargesheet against Saquib Nissar and other accused – Mohd Saif, Zeeshan Ahmed, Zia-ur Rehman and Mohd Shakeel in the September 13 serial blasts.
They have been accused of murder, attempt to murder and waging war against the nation amongst other offences under the Indian Penal Code, the Unlawful Activities (Prevention) Act and the Explosive Substances Act.
According to the police, all the accused in the serial blasts case who have been named in the chargesheet were also involved in the serial blasts in Jaipur and Ahmedabad.
They had visited Ahmedabad before the July 26 blasts under fake names which came to light during the investigations and was later confirmed by examining the railway tickets and reservation chart, the police had alleged in the chargesheet.
