Veteran Congress leader ND Tiwari will have to tell the court today decision he has made, on the paternity suit against him.
The Delhi High Court on Monday had given Mr Tiwari two days to either “gracefully appear” for a DNA test, or be forced to take the test by the Delhi Police.
Mr Tiwari, the former Chief Minister of Uttar Pradesh and Uttarakhand, has already been directed by the high court and the Supreme Court to furnish a blood sample for the DNA test.
Justice Reva Khetrapal told the counsel for 86-year-old Tiwari that his client will not leave India till he gives his blood sample for the requisite DNA test.
The court, meanwhile, has also directed the Hyderabad-based Centre for DNA Fingerprinting and Diagnostics (CDFD) to send “requisite kits” for the DNA test to the registrar of the court.
On Monday, the court also rejected the plea of Tiwari’s counsel that a week’s time be granted to him for taking instruction in this regard from the Dehradun-based Congress leader.
The court’s directions came on an application of 32-year-old Rohit Shekhar, who filed a paternity suit seeking to declare Mr Tiwari as his biological father. A single judge and a division bench of the high court had asked Tiwari to go for a DNA test.
A two-judge bench of the high court had said that even police force could be used for compelling Mr Tiwari to comply with the earlier order in the case as non-implementation of judicial orders would make courts a “laughing stock”.
The veteran leader had recently suffered setbacks in the high court and the Supreme Court in his bid to avoid giving his blood sample.
Mr Tiwari had moved the apex court against the order but he did not get the desired relief.
