Court rejects TN plea for withdrawal of case against Jaya

Bangalore, September 10: A special court here today dismissed an application filed by the Tamil Nadu government seeking permission to withdraw the London Hotel case, one of the many disproportionate assets cases filed against former chief minister Jayalalithaa.

Pronouncing the order, Judge Malliakarjunaiah observed that since the state government filed the case stating that it was in the public interest, it cannot be allowed to withdraw it now.

Malliakarjunaiah also rejected the contention of the prosecution that lack of evidence against the accused prompted it to seek withdrawal of the London Hotel case.

Besides Jayalalithaa, former AIADMK MP T T V Dinakaran is also an accused in the case in which she has been accused of illegally acquiring property abroad.

With this verdict, the trial of London Hotel case and another disproportionate assets case would continue before the court.

However, the trial cannot resume until the Supreme Court takes a decision on the stay of proceedings it granted in 2006 in the wake of a DMK functionary challenging the clubbing of the assets case and London Hotel case for trial.
