Civil contracts cannot be awarded by nomination

Hyderabad, April 14: A division bench of the AP High Court comprising Justice G Raghuram and Justice Naushad Ali on Tuesday injuncted the State Government from awarding any civil contracts by nomination. The bench further stayed payment of bills with regards to a work undertaken by Maytas in Kadapa.

The work was awarded by the Government relying on its order which permitted such action in circumstances where connected major works were otherwise allotted to a party.

The nearby road-laying project under the Rural Rehabilitation Programme was awarded to Maytas on a nomination basis after it was awarded a major work in the nearby area. The petitioner Ramesh Reddy, a resident of Kadapa complained the practice of awarding civil works by nomination was contrary to the known procedure of law and made the exercise whimsical.

Pension scheme for bank employees

Justice R Subash Reddy of the AP High Court on Tuesday made it clear that any agreement between nationalised banks and the Indian Banks Association on the pension scheme and extension of option would be subject to further orders of the court. The judge ordered notice in a writ petition filed by P Ramakrishna and four other bank employees.

The Memorandum of Understanding between nationalised banks and the IBA visualises one final option to employees past and present to opt for the pension scheme instead of the PF scheme. The petitioners contended that they cannot be forced upon to participate in the pension scheme.

HC summons PR Secy, Nizamabad collector

Justice NV Ramana of the AP High Court on Tuesday summoned the Secretary, Panchayat Raj and the Collector of Nizamabad.

The officials will be required to be present in court on Monday. The judge was dealing with a writ petition filed by Lakshmi Devi, an ex Sarpanch of Gulla Big village in Nizamabad district who complained about the contrasting stance taken by the authorities.

According to the petitioner, the Government had taken the stand that allegations of financial irregularities against her and claims that she had not completed works of about Rs. 5 lakh was rejected by the Government in a public interest writ petition. Despite the said stance, the authorities called upon her through a show-cause notice to make the good the payment.
