Cabinet nod to raising pecuniary jurisdiction of Daman court

New Delhi, February 05: The people of Daman and Diu will not have to approach the Bombay High Court any more for civil suits involving stakes of more than Rs 25,000 with the Union Cabinet today deciding to raise the limit to Rs one lakh up to which the local courts in the Union Territory can entertain.

The cabinet meeting, chaired by Prime Minister Manmohan Singh, approved promulgation of the Daman and Diu Civil Courts (Amendment) Regulation, 2009, an official spokesperson said.

The regulation will provide for an increase in the pecuniary jurisdiction (the maximum amount of stake involved in a civil suit) of the court from the existing Rs 25,000 to Rs one lakh.

The Civil Courts in Daman and Diu come under the jurisdiction of Bombay High Court. During a visit to Diu last year, the Chief Justice of the Bombay High Court had spoken about increasing the pecuniary jurisdiction as litigants were forced to travel to Mumbai for filing appeals due to the existing limit.

The UT administration had later recommended increasing the limit which the Cabinet approved today. The Cabinet also decided to revise the designation of Junior Civil Judge as Civil Judge (Junior Division) and Senior Civil Judge as Civil Judge.
