Mumbai, September 21: One of the accused in the Aurangabad arms haul case has moved the Bombay High Court claiming that trial court is giving precedence to Mumbai serial train blasts case, which took place later in point of time.
Both the cases are being heard by special Maharashtra Control of Organised Crime Act court, but petitioner Dr Shabbir Ahmed, who is in jail for over four and half years, has said in the petition that Special court is busy with train blasts case.
“This violates his right to equality, and to speedy trial,” Shabbir’s lawyer, Advocate Sushant Kunjuraman said.
The petition seeks a stay on the train blasts trial, or a simultaneous trial of both the cases. If this is not possible, the arms haul case should be transferred from the court of MCOCA judge Y D Shinde, it prays.
