Atali mosque of Ballabhgarh was declared Muslim property by court

Faridabad court pronounced the judgment that the mosque situated at Atali village of Ballabhgarh of Haryana State is a Muslim property. The Court observed that Hindu petitioners had utterly failed to establish that the land belongs to Village Panchayat. It may be noted that communal violence erupted on 26th May in Atali Village. 2,000 heavily armed men set ablaze many Muslim houses and business establishment within a span of one 1 hour. In this communal violence 15 persons were injured. More than 150 Muslim are taking shelter in Ballabhgarh police Station since then. They are so afraid of the miscreants that they don’t want to return to their homes in the village.

Satish Kumar and Yogender of Atali village had filed a petition in the court that the gram panchayat is the absolute owner land and that the mosque built on this land is an illegal possession by the Muslims. The Muslims claimed that the land belongs to the Waqf Board. The Jat communities contended that the land was meant for a graveyard not for a mosque. Justice Vinay Sharma, Civil Judge of Fareedabad Court pronounced a judgment on 31st March that the disputed property has always been in possession of the Muslim community.
The Muslims produced a gazette notification dated November 21, 1970 and the electricity bill as proof of ownership of Jama Masjid, Atali.

The court observed that there is no merit in the claim made by Hindus. After examining the records of jama bandis from 1954-55 to 2005-2006, the court came to a conclusion that the property belongs to the Muslims.
