Arab woman filed case against father for choice to marry

Dubai, July 23: Dubai Court of First Instance has written off a case filed by an Arab woman against her father accusing him of preventing her from marrying a Turkish man she likes.

The plaintiff, who is a 28-year-old GCC national, works as assistant professor in one of the universities in the country.

The court disqualified the case because the plaintiff failed to appear for the hearing, which was scheduled for July 5.

The woman formally filed a case on June 21, requesting the judge to be her guardian and seeking permission to marry the Turkish man.

The Court papers confirmed that the girl based her claim on the third clause of Article 30 of the Personal Status Law of UAE. This clause provides that, if a woman who is eighteen years old and above and seeks to get married but is refused by her guardian then she may refer the matter to the court.

The judge then calls the guardian to appear before the court and seeks his explanation for not allowing the woman to marry. In case he doesn’t appear in the court or his objection is not acceptable by the court then the judge has the power to be the guardian of the lady and give consent to her marriage.

The father in this particular submitted a note to the judiciary detailing his reasons for objection. The note read: “My daughter had previously rejected proposals from finest young people from home who are good in conduct and efficient without offering any convincing reasons.”

He added that he dedicated his life to her care and education and stressed that he does not know the origin or nationality or religion, tribe or family of the person who wants to marry his daughter, that is why he denied permission.
