323 acres and 18 guantas wakf land identified in Jubilee Hills

Jubilee Hills is supposed to be a very expensive area and a plot of land is considered to be a secure asset. When the resident of this area come to know that the property, which they are occupying, belongs to A.P. State Wakf Board then they will get disturbed. A.P. State Wakf Board, taking a very courageous step, decided to make correction in the wakf’s records of the land admeasuring 323 acres and 18 guantas belonging to Dargah Hazrath Sayedna Hakeemul Mulk Moosavi Al Hussaini alias Hakeem Shah Baba.

It may be noted that a Muntakhab was released pertaining to this wakf property situated at Tolichowki in Golconda Mandal which was attested by the Asif Jahi Kings. Under this Muntakhab,323 acres and 18 guantas of land under Survery numbers 92 and 102 was surveyed by commissioner of Wakf s in 1970. By mistake its area was shown as 4448 sq yards where as in column number 5 in survey report, there was a mention of Dargah Hazrath Hakeem Shah Baba, Masjid, Travels bungalow and a hilly land. A few days back when this fact was brought to Maulana Syed Gulam Afzal Biyabani, alias Khusroo Pasha they 323 acres and 18 guantas of land belongs to wakf and the documentary proofs of it are preserved in the Archives. Since this was not mentioned in the gazette, illegal possessions were from this land. He instructed the officials of A.P. State Wakf Board to retrieve the records of the Dargah land and to include this item on the agenda. A.P. State Wakf Board passed a unanimous resolution in exercise of the powers conferred on it by section 40 of Wakf Act 1995 for making corrections in the gazette notifications 26-C of first July 1982 and to issue a corrigendum of the GO.

It may be noted that under the Wakf Act, Wakf Board is empowered to gather information about a property for which there are reasons to believe that it belongs to wakf board and it can also issue a notification declaring it a wakf property. Exercising these powers, A.P. State Wakf Board has decided to issue the corrigendum of the notification declaring 323 acres and 18 guantas of land pertaining to survey number 92 and 102 of Hakeempet village as wakf property. After the issue of corrigendum of the notification, Wakf Board is empowered to issue notices of eviction to the illegal occupants of the wakf property. In the agenda of the wakf board pertaining to this issue it has also been indicated that Task Force of wakf board has surveyed this property and has submitted its report on 19th September, 2011 in which it was state that the properties of Kareem Nagar and Apollo Hospitals situated in Jubilee Hills are wakf properties. It is worth mentioning that, the decision of the wakf board under section (2) read with sub section (1) of article (40) of wakf act will be final unless Wakf Tribunul makes an amendment in it or cancels it. Another import decision was made in the meeting of the Wakf Board that a sum of
2, 500 each should be granted for the burial of the destitute Muslim dead bodies in the districts. By writing letters to District Superintendents of Police will be requested to hand over the unclaimed Muslim dead bodies to the district Inspector and Auditor of the Wakf Board so that he could made arrangements for their burials according to the Islamic rites and rituals. In yesterdays meeting 76 issues were presented in which the nominations of 7 Mutawallis (custodians), formation 21 managing committees of the mosque, 5 proposals of constructions and 5 items of corrigendum in the GO. The property of Hakim Shah Baba situated at Jubilee Hills is valued at Rs.10, 000 crore. Next step of the Wakf Board would be to conduct a survey on its own the Wakf land pertaining to survey number 92 and 102 and to identify the properties constructed on this land. Wakf Board will also obtain more records from the department of revenue and would issue eviction notices one after the other to all the owners of these properties. For eviction.
